Abstract: Research in private military and security companies has matured over the last fifteen years. This essay reviews past research and identifies three areas needing further attention; progress in these areas is critical for guiding security and defense policies and establishing effective regulations. Private military and security companies became a topic of research in the early s, and is a matter of great interest for academics, journalists, and practitioners alike.
When state armed forces are deployed in the context of armed conflict situations or crisis management operations it has become fairly common that they are accompanied and supported by employees of private business entities, often referred to as Private Military and Security Companies PMSCs. The name notwithstanding, PMSCs do not have a military status, but are private businesses contracted to perform a wide array of functions that traditionally were carried out by active duty military. These functions include training; logistic support, such as transport, maintenance and repair; base support; and even operational duties, such as collecting and analyzing intelligence and providing armed security services. Although civilians accompanying the armed forces are not a new phenomenon, reliance on the private sector to support military operations has steadily increased since the end of the Cold War. The presence of so many civilians in the area of military operations, working closely together with the military without actually being part of the armed forces, has led to incidents raising a number of legal concerns that have received wide academic attention.

This paper explores the roles that experts, specialized systems of knowledge and law play in the legitimization of private transnational governance. Governance of the global political economy and society is increasingly being shaped by private actors, institutions and processes that operate transnationally, linking local and global orders through complex laws and regulatory arrangements. These private governance arrangements are legitimized through their claims to possess expert knowledge and authority. However, adopting the lenses of critical theory, this paper seeks to problematize the tendency to defer unquestioningly to expert opinion. It argues that uncritical deference to experts is symptomatic of deeper conditions that are linked to the dominant form that law takes under contemporary capitalism. This paper examines the nexus between knowledge and power and the specific place that experts have in the legitimization of private modes of governance under contemporary conditions of post-modern legality and late capitalism.

Private Military and Security Companies PMSCs have been gaining increasing media and scholarly attention particularly due to their indispensable role in the wars in Afghanistan and Iraq Nevertheless, theoretical insights into the agency problems inherent when hiring PMSCs and how to optimally incentivize them are scarce. We study the complex relationship between intervening state, host state, and PMSC, taking into account the diverging interests of all involved parties as well as potential agency problems. We find that it might be optimal to hire PMSCs even if they are expected to do a worse job than the intervening state would do itself.
